General Terms of Use of the MOOC discussion forum

The MOOC forum is an external tool to the FUN platform hosted and managed by Inria.

The purpose of this text is to define the terms and conditions under which, on the one hand, Inria makes available to its users the forum of the MOOC (hereinafter referred to as “forum”), and the associated services and, on the other hand, the way in which the user accesses the forum and uses its services.

Any connection to the forum is subject to compliance with these conditions.

For the user, simple access to the forum at the following URL address https://mooc-forums.inria.fr/moocsl/ or via the FUN platform implies acceptance of all the conditions described below.

1. Your account on the MOOC forum

By accepting the creation of an account on the forum, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur with your account. You must immediately notify Inria of any unauthorized use of your account or any other breach of security. Inria shall not be liable for any acts or omissions on your part, including any damages of any kind incurred as a result of such acts or omissions.

2. Liability of contributors

If you submit content, links, etc. to the forum, or make (or allow a third party to make) content available through the forum means (any type of content), you are entirely responsible for such content, and for any damage resulting from such content. This applies whether the content in question is text, image, audio or software… By making this content available, you represent and warrant that :

  • the downloading, copying and use of the content does not infringe the proprietary rights, including, but not limited to, the copyrights, patents, trademarks or trade secrets, of any third party;
  • if your employer has intellectual property rights in what you create, you must either (i) have received permission from your employer to post or make available the content (including, but not limited to, any software), or (ii) have obtained a waiver from your employer of all rights or content;
  • you have fully complied with third-party licenses for the content, and have done all necessary things to comply with the terms of the end-user terms and conditions;
  • the content does not contain or install viruses, worms, malware, Trojan horses or any other harmful or destructive content;
  • the content is not spam, is not generated randomly or by machine, and does not contain unethical or unwanted commercial content, designed to generate traffic to third party sites or stimulate search engine rankings of third party sites, or acts of an illegal nature (e.g. phishing) or mislead recipients as to the source of the content (such as identity theft);
  • the content is not pornographic, does not contain threats or incite violence, and does not violate the privacy or rights of a third party;
  • your content does not contain advertising to unwanted electronic messages such as spam, newsgroups, email lists, blogs and websites or any similar promotional methods;
  • your content is not named in a way that misleads your readers into thinking that you are another person or company;
  • you have, in the case of content that includes computer code, accurately classified and/or described the type, nature, uses and effects of that code, whether or not Inria requests it.

3. Licensing of forum user content

User contributions are under Creative Commons BY-NC-ND License: the user must mention the author’s name, he may exploit the work except in a commercial context and he may not make any modifications to the original work.
Without limiting any of these representations or warranties, Inria has the right (although not the obligation) in its sole discretion to (i) refuse or remove any content that, in Inria’s reasonable opinion, contravenes its policy or is harmful, or unacceptable, or (ii) terminate or refuse access to the forum and use of this site to an individual or entity for any reason, at Inria’s sole discretion.

4. Responsibility of forum users

Inria has not reviewed and cannot review all content, including software, posted on the forum, and therefore cannot be held responsible for the content, use or effects of such content. Even if Inria administers the forum, this does not imply that it approves the content posted, or that it believes that the content is accurate, useful or not harmful. You are responsible for taking the necessary precautions to ensure that you and your computer systems are protected against viruses, worms, Trojan horses and other harmful or destructive content.

The forum may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical errors and other errors. The forum may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, declared or not declared. Inria declines all responsibility for any damage resulting from the use by users of the forum, or from any download by users of the content posted here.

5. Content published on other sites

We have not examined, and cannot examine, all content, including software, made available by websites and web pages to which the forum links and which link to the forum, Inria does not have control over these websites and is not responsible for their content or use. By connecting to a “non inria.fr” site, Inria is no longer responsible for the page or website. You are responsible for taking the necessary precautions to ensure that you and your computer systems are protected from viruses, worms, Trojan horses and other harmful or destructive content. Inria declines all responsibility for any damage resulting from your use of the “non inria.fr” websites and web pages.

6. Copyright infringement

Inria requires forum users to respect intellectual property rights, Inria will respect intellectual property rights. If you believe that the content on the forum constitutes copyright infringement, you are invited to inform Inria. Inria will respond to all notifications, including those requesting to delete content or disable all links to illegal content. Inria will terminate access and use of the forum by a user if it is determined that the user has repeatedly infringed the copyright or other intellectual property rights of Inria or third parties.

7. Modification of the terms of use

Inria reserves the right to modify these terms of use. If this were the case, Inria would inform the users of the forum.

8. Termination of contract

Inria may terminate your access to the forum at any time, with or without cause. On your side, you can delete your account and stop using the forum.

9. General representation and warranty

You represent and warrant that (i) your use of the website will be in strict compliance with the MOOC Forum Privacy Policy and Forum Charter, this Agreement and all applicable laws and regulations (including, without limitation, local laws or regulations in your country, state, city, or other government area, with respect to online conduct and acceptable content, including all applicable laws regarding the transmission of technical data exported from the country in which this site resides or the country in which you reside) and (ii) your use of the site will not infringe or misappropriate the intellectual property rights of a third party.
